Update on OCA's Refusal to Negotiate

This is an update on the ongoing progress in response to the OCA's refusal to negotiate.

Today, COBANC filed an Improper Practice Charge (IP) with the Public Employment Relations Board (PERB), against the New York State Unified Court System.

OCA has refused to negotiate, is negotiating in bad faith, and unilaterally implementing changes to mandatory subjects of bargaining over COBANC's objection. The UCS has violated Sections 209-a (l)(a) and (d) of the act.

COBANC requests that PERB issue a decision and order, declaring that the UCS violated these sections, order the UCS to cease and desist implementation of the COVID vaccination mandates and grant such further relief that PERB deems just and proper.

COBANC also intends to file a separate application for Injunctive Relief pursuant to 204.15 of the Board's Rules of Procedure.

Please know that COBANC, our labor counsel Davis and Ferber, and the other 11 unions have been working to protect all our members' rights on both sides of the aisle when it comes to this subject and will continue to do so. We will not be influenced by radical ideas or movements.
