World Trade Center Sick Leave

World Trade Center Presumption Law

If you participated in the World Trade Center rescue, recovery or clean up efforts, you may be able to take advantage of the World Trade Center Presumption Law. It provides a presumption that, if you are or become permanently disabled due to certain conditions and unable to perform your job, you can claim the condition was the result of your participation in the events of September 11th and after, unless it can be proven the condition was the result of other factors. If you are permanently disabled, this law will help you qualify for a World Trade Center accidental disability presumption or help your beneficiaries become eligible for an accidental death benefit.

The deadline for members to file a notice with NYSLRS of their participation in the World Trade Center rescue, recovery or clean up efforts has been extended to September 11, 2022.

World Trade Center Sick Leave

If you participated, even on a voluntary basis, in the World Trade Center rescue, recovery or cleanup operations and have since developed a qualifying World Trade Center condition, as defined in section two of the Retirement and Social Security Law, you may be eligible for sick leave at full pay and without charge to accruals for absences due to this condition (“WTC Sick Leave”). Eligible employees may be entitled to restoration of prior sick leave accruals.

Filing is a 2-step process. The first step is to file a notice with the New York State and Local Retirement System (NYSLRS). If you participated in the World Trade Center rescue, recovery or cleanup operations you should file this first step regardless of whether or not you have currently developed a qualifying World Trade Center condition yet. The deadline to file the first step is September 11, 2022. Please click the links below for detailed instructions and forms.

September 11th Victim Compensation Fund

The September 11th Victim Compensation Fund (VCF) provides compensation to individuals (or a personal representative of a deceased individual) who were present at the World Trade Center or the surrounding New York City Exposure Zone; the Pentagon crash site; and the Shanksville, Pennsylvania crash site, at some point between September 11, 2001, and May 30, 2002, and who have since been diagnosed with a 9/11-related illness. The VCF is not limited to first responders. Compensation is also available to those who worked or volunteered in construction, clean-up, and debris removal; as well as people who lived, worked, or went to school in the exposure zone.
